Auditors
For the purposes of the Biomethane T&C, an “auditor” shall mean any natural person or legal entity within the meaning of § 8 para 3, third sentence, ÖSG 2012, who is a certified public accountant, civil engineer, generally sworn and judicially certified expert or a technical office in the fields of electrical engineering, mechanical engineering, combustion engineering or chemistry and who is deemed to be a technical expert within the meaning of § 21 para 1 ÖSG 2012 (Renewable Power Act).
The function of an auditor account is limited to the possibility of entering auditing reports and auditor annotations including corresponding explanations after audit commissioned by a plant operator has been carried out to fulfill certain criteria for external bodies (e.g. funding agencies)."
Proof of qualification
The auditor has to prove their expert status in the sense of § 21 para 1 ÖSG 2012 and their qualification by the complete transmission of the documents designated on the “Application Form for Auditors” in its current version (hereinafter referred to as “proof of qualification”) to the registry operator.
If a circumstance arises as a result of which the person registered in the Biomethan Register Austria as an auditor is no longer to be regarded as an auditor within the meaning of the Biomethane T&C, the respective person registered in the Biomethan Register Austria as an “auditor” shall immediately inform the registry operator thereof. In this case, the registry operator will immediately block the relevant registry account or temporarily revoke the access registry system of the person registered as an auditor. The provisional withdrawal of the access shall be revoked if the respective person registered as an auditor is able to prove their expert status by submitting an appropriate proof of qualification within one month of the provisional withdrawal of the authorisation by the registry operator.
